Lutz is one community in two counties. It grew up around the old rail depot on US-41 at Lutz-Lake Fern Road in Hillsborough County, and its ZIP codes now run north across the county line to SR-54 in what people call Pasco Lutz. About 24,000 people live here, with I-275 on the east side joining I-75 in the northeast corner, Dale Mabry Highway on the west, and US-41 straight through the middle.
Conde-Huggins Accident Injury Lawyers is a Pasco County firm on Ridge Road in Port Richey, and we handle injury claims on both sides of the Lutz line. The law is the same in both counties; the agencies and courthouses are not. We know both, and we come to you. Call (240) 421-5511 for a free consultation.
Lutz crash corridors
US-41. The main street of Lutz is also the main north-south road of central Pasco, where it becomes Land O' Lakes Boulevard. In Lutz it is a mix of highway speeds and driveway access, with the historic town center at Lutz-Lake Fern Road, schools, churches and plazas opening directly onto it, and the heavy intersection with SR-54 at the Pasco end.
SR-54. State Road 54 marks the northern edge of Lutz. From the Suncoast Parkway east to US-41 and on to Wesley Chapel, it carries the commuters, deliveries and construction traffic of the fastest-growing part of the county. The plazas and apartment communities along it generate a constant stream of left turns across heavy traffic.
Dale Mabry Highway (SR-597). Dale Mabry forms part of Lutz's western border and funnels traffic from Carrollwood and north Tampa into the community. Van Dyke Road links it to the hospital.
Van Dyke Road and Lutz-Lake Fern Road. These east-west roads connect US-41, Dale Mabry and the Suncoast Parkway. They carry hospital traffic, school traffic and commuters avoiding the highways, often on two lanes.
I-275 and I-75. The interstates on Lutz's east side are Florida Highway Patrol territory, and the crashes there are high-speed. Local reporting on crashes in the area has named I-275 between Bearss Avenue and SR-56 as a repeated site of serious collisions.

Which agency, which county, which courthouse
Lutz has no police department of its own. The Florida Highway Patrol, Troop C, covers both Pasco and Hillsborough and handles most serious crashes on US-41, SR-54, Dale Mabry and the interstates. On local roads, the Pasco Sheriff's Office responds north of the county line and the Hillsborough County Sheriff's Office responds south of it.
This matters in three ways. First, the report comes from a different agency depending on which side of the line you were on. Second, the Pasco Sheriff's Office generally does not complete long-form crash reports, so a Pasco-side crash worked by a deputy may have a thinner record than the same crash a mile south. Third, if the case has to be filed, a Pasco crash goes to the Pasco courts and a Hillsborough crash goes to Tampa. Clementine Conde has practiced in Tampa Bay courts since 1992 and handles both.
Whatever the report says, we build our own file: photographs, 911 audio, witness statements and video from the businesses along US-41 and SR-54. That evidence is gone in weeks. Call (240) 421-5511 early.
After a crash in Lutz: three things to write down
Because of the county line, the first minutes matter more here than in most places.
- The nearest cross street. "US-41 near Lutz-Lake Fern Road" tells us the county; "US-41 in Lutz" does not.
- The agency on the officer's uniform and the report number. FHP, Pasco Sheriff and Hillsborough Sheriff each keep their own records, and the wrong request wastes weeks.
- Where you were treated. The hospital record is the first medical evidence in the case and the proof that you met the 14-day PIP rule.
If you have those three things, we can start the same day. If you do not, we will find them.
Hospitals that serve Lutz
St. Joseph's Hospital-North, 4211 Van Dyke Road, is in Lutz itself and has an emergency department. The Pasco side near SR-54 is also close to AdventHealth Wesley Chapel and BayCare Hospital Wesley Chapel, both on Bruce B. Downs Boulevard. The most serious trauma goes to the Level I trauma centers in Tampa.
Florida's no-fault law requires initial medical treatment within 14 days of the crash for PIP to pay at all. A same-day ER visit satisfies the rule. If you went home from the scene, see a doctor now and tell them it was a car crash.
Florida law for Lutz injury claims
Two years. Fla. Stat. § 95.11(5)(a) sets a two-year deadline for negligence claims arising after March 24, 2023, in both counties. Wrongful death is two years under § 95.11(5)(e).
The 51 percent bar. Under Fla. Stat. § 768.81(6), a person found more than 50 percent at fault recovers nothing, and any lesser share reduces the award. US-41 left-turn crashes and SR-54 lane-change crashes are the classic disputed-fault cases, and the evidence we collect in the first weeks is what resolves them.
PIP and the threshold. Your own PIP pays 80 percent of medical bills and 60 percent of lost income up to $10,000 regardless of fault, but the medical benefit is limited to $2,500 unless a physician, PA or APRN documents an emergency medical condition. Pain and suffering from the at-fault driver requires a permanent injury, significant scarring, or death under Fla. Stat. § 627.737(2).
UM/UIM. Florida does not require bodily injury liability coverage on most private vehicles. When the other driver has nothing, your own uninsured/underinsured motorist policy under Fla. Stat. § 627.727 is often the largest source of recovery. We review every policy in your household.

Questions people ask us about lutz car accident cases
My crash was in Lutz. Is that Pasco County or Hillsborough County?
It could be either. Lutz is an unincorporated community that runs from northern Hillsborough County across the line into southern Pasco County, up to SR-54. The Lutz ZIP codes, 33548, 33549, 33558 and 33559, cover both. The county determines which sheriff's office may have responded and which courthouse hears the case. The Florida Highway Patrol covers both counties. We sort this out at the first call.
Who investigates a crash on US-41 in Lutz?
Usually the Florida Highway Patrol, Troop C, which covers both Pasco and Hillsborough. On local roads, the responding agency is the Pasco Sheriff's Office north of the line or the Hillsborough County Sheriff's Office south of it. The exchange slip from the scene identifies the agency and report number, and any agency's report can be bought through the Florida Crash Portal for $10 plus a $2 fee.
Which hospital is closest to Lutz after a crash?
St. Joseph's Hospital-North, a BayCare hospital at 4211 Van Dyke Road in Lutz, has an emergency department and is the closest for most of the community. Residents on the Pasco side near SR-54 may also go to AdventHealth Wesley Chapel or BayCare Hospital Wesley Chapel on Bruce B. Downs Boulevard. Serious trauma goes to the Level I centers in Tampa. We meet clients at any of them.
Does the county line change the deadline or the law that applies?
No. Florida law applies on both sides. Negligence claims must be filed within two years under Fla. Stat. § 95.11(5)(a), the 51 percent comparative fault bar in § 768.81(6) applies, and PIP works the same way. What changes is venue: a Pasco-side case is filed at the West Pasco Judicial Center or in Dade City, a Hillsborough-side case in Tampa. Our attorney has practiced in Tampa Bay area courts for decades.
How long do I have to file after a Lutz accident?
Two years from the crash for negligence claims under Fla. Stat. § 95.11(5)(a), and two years for wrongful death under § 95.11(5)(e). Crashes before March 24, 2023 keep the older four-year period. If a Pasco or Hillsborough county vehicle or a school bus was involved, written notice under Fla. Stat. § 768.28(6) is required first.
